The Commission for Teaching as well as cultural and social affairs in the House of Council approved late on the night of Friday, Bill No. 97.15, which frames the right to strike. The text was adopted by the majority with 10 votes for and 5 against the examination of 218 changes proposed by parliamentary groups and unions.
The Minister of Economic Integration, Younes Sekkouri, emphasized that several progress was made, in particular to a broader definition of strike rights and the integration of the moral and indirect interests of employees. From now on, all professional categories, including self -harm and domestic workers, are affected by this law.
Under the main changes, the deadlines for the request for strike in the private sector were reduced by 10 to 7 days, while the message has increased from 7 to 5 days. In addition, the sanctions against employers who do not respect the law were hardened with fines of up to 200,000 dirhams. A provision was also added to protect insolvent workers from physical restrictions in the event of a financial sanction.
The government was the need to reconcile the right to strike and continuity of essential services by determining a clear framework for the minimum service. In the event of disagreement between employers and unions of the required staff, justice can be confiscated. State intervention to suspend a strike is only possible in the event of a major crisis or natural disaster.
The text, which is considered balanced by the government, reacts to international standards in relation to striking law, while the possibility of “sudden strikes” is rejected, which is considered unacceptable by the international work organization. Before his final acceptance in the plenary session, discussions on certain points are still being carried out, in particular the preamble of the invoice.
