The Newcastle striker Anthony Gordon will definitely miss the final of the Carabao Cup against Liverpool in Wembley on March 16, after the club had decided to calculate against its deposit last week.
Gordon was shown a straight red card to push the Brighton defender Jan Paul van Hecke, and will now start a three-game ban.
Manager Eddie Howe says there is no chance of lifting the decision.
He said: “It is always a point of discussion and we discussed him with a club with the respective people with whom we had to discuss – lawyers, etc. – and we had the feeling that there were not enough reasons to make a call.
“There was no intention of Anthony. He didn’t want to hurt anyone.
“But you have to look at it and wonder if there is a chance to be successful and whether there is no chance, which is the meaning of the appeal – Anthony understands that.”

Gordon will miss the trip to West Ham on Monday, while the left -back Lewis Hall fails for the season.
“Lewis was in a really good shape and well played, so it’s a big blow for him and us,” said Howe.
“The most important thing is now his recovery and sure that he comes back as well as he is.”
Botman for two months
Newcastle will still be without defense lawyer Sven Botman for the trip to London, how -Howe shows that the Dutch is on the road for another two months.
Botman only made five appearances all season.
Howe said: “With Sven we tried to bring him close to full fitness, and he was actually very close to the Brighton game, but the day before he felt the same problem in his knee.
“That meant reset and we still hoped that he could come back, but this week he felt the same discomfort again, so that it now looks like he was going to have an operation.
“We hope that he will be back in about eight weeks.”
