Jay Z rape accuser’s claim is too old to pursue, lawyer says
Jay Z is trying a different approach after a judge ruled that the Wife sues him can remain anonymous.
Accordingly Rolling Stone And deadlinethe rap mogul’s lawyer, Alex Spirofiled new paperwork on Monday, December 30, attempting to appeal a lawsuit accusing Jay-Z of rape The alleged attack is said to have taken place months before a law from December 2000 came into force that provides civil legal protection for victims of gender-based violence. In December 2022, the New York City Council changed the law to give people a two-year window to file historical claims that might otherwise be barred.
“The plaintiff cannot assert her only claim under the Act for the Protection of Victims of Gender-Based Violence (GMV Act) for legal reasons, as the law does not have retroactive effect,” Spiro wrote in a letter to Judge Analisa Torresper deadline.
He continued: “The plaintiff alleges a breach of the GMV Act for conduct alleged to have occurred in September 2000. However, the GMV Act was only enacted on December 19, 2000, three months after the FAC alleged the conduct, and cannot be applied retroactively to a cause of action that was not available to the plaintiff at the time in question.”
In a lawsuit filed earlier this month, Jay-Z’s accuser, identified only as “Jane Doe,” claimed she had been raped from the rapper and fellow musician Sean “Diddy” Combs at an MTV Video Music Awards afterparty in 2000. She said she was 13 at the time. (Both Jay-Z and Diddy have denied the allegations.)
Last week, Judge Torres says court documents TMZ has learned that Jane Doe can remain unnamed after Jay-Z’s lawyer requested it the case was dismissed and Doe’s identity revealed. However, the judge noted that circumstances could change as the proceedings progress. Torres said she plans to revisit the issue if the case moves forward.
Torres also accused Spiro of being combative and trying to “rush the case,” the source said.
lawyer Tony Buzbeewho represents Doe, said in a statement to Us weekly“I don’t normally comment on court rulings. I must say that the coordinated and desperate efforts to attack me as an advocate for the alleged victims are failing.”
Buzbee and Jay-Z are also embroiled in their own legal battle. Jay-Z – real name Shawn Carter – is suing Buzbee, accusing him of extortion and defamation. Buzbee filed his own lawsuit against Jay-Z’s Roc Nation Earlier this month, he alleged that the company bribed its customers to file lawsuits against his firm, threatened former customers and posed as government officials. (Roc Nation called the complaint “nonsense”.)
