Blake Lively’s lawyers are calling Justin Baldoni’s It Ends With Us footage “damning” for the actor

In their statement, Lively’s lawyers claimed that Baldoni “improvised” the scene and made the actress uncomfortable since there were supposedly no prior conversations.
They also noted that while Lively and Baldoni were co-stars, the actor also served as director and her “employer,” suggesting there was a power imbalance.
The lawyers said: “Every moment of this was improvised by Mr Baldoni, without prior discussion or consent and without the presence of an intimacy coordinator. In addition to being Ms. Lively’s co-star, Mr. Baldoni was the director, the head of the studio, and Ms. Lively’s boss.”
According to the legal team, it was not an act that the actress leaned away from Baldoni in the scene as she appeared to feel “discomfort” after allegedly being touched without consent.

“The video shows Ms. Lively leaning away and repeatedly asking the characters to just talk,” Lively’s attorneys continued. “Any woman who has been touched inappropriately in the workplace will recognize Ms. Lively’s discomfort. She will recognize her careless attempts to ward off the unwanted touch. No woman should have to take defensive measures to avoid being touched by her employer without her consent.”
Justin Baldoni’s bombshell behind-the-scenes look at It Ends With Us footage

In the footage, the two can be seen having an uncharacteristic conversation, exchanging jokes about Baldoni’s nose and Lively’s tan.
In Lively’s legal complaint, she alleged that during a “slow dance scene,” Baldoni leaned forward, slowly trailed his lips from her ear to her neck and said, “It smells so good.”
However, the video shows Lively seemingly joking about possibly getting a spray tan from Baldoni, to which he laughs and responds, “It smells good.”
